1. Using myKomunidad
These terms govern use of the myKomunidad website and community app. By using the service, you agree to these terms to the extent permitted by law. If you do not agree, do not use the service. The Privacy Policy explains how personal information is handled.
myKomunidad provides tools for Philippine HOA and subdivision administration. It does not replace your HOA's governing documents, valid resolutions, statutory duties, or lawful local rules. An officer using the service for an HOA must have authority to do so. Users must have legal capacity or appropriate parent or guardian authorization.
2. Accounts and approval
Provide accurate account, role, community, and property information, and keep it current. Signup does not guarantee access: accounts are subject to approval, and permissions depend on the role and subdivision assigned by authorized administrators.
Keep your sign-in credentials private and tell us promptly if your account is compromised. Do not impersonate another resident, claim an unauthorized role, share accounts to bypass access restrictions, or access another subdivision's private records.
3. HOA responsibilities
Your HOA is responsible for the accuracy and lawful handling of its records, its member eligibility decisions, dues and charges, payment review, facility availability, visitor rules, documents, announcements, and elections. Officers must obtain appropriate authority and any necessary consents before uploading records about other people.
The platform does not independently guarantee that an HOA record, receipt, election, or filing satisfies every legal requirement. Contact your HOA about community decisions and record corrections; contact myKomunidad about platform access or service issues.
4. Lifetime-free founding community offer
The first five subdivisions receive free-for-life myKomunidad access and free setup. This replaces the previously advertised per-unit pricing and one-month trial. A confirmed founding subdivision has no myKomunidad subscription fee and no trial expiry; its members, including those who join later, share that access.
After account approval, an authorized HOA officer claims an available founding place from the dashboard. Places are confirmed in successful claim order, once per subdivision, up to five subdivisions. Creating an account alone does not reserve a place. Repeat claims preserve the original confirmed place.
HOA dues, facility charges and service-provider fees remain separate and are not waived by this offer. No paid pricing is currently published for subdivisions beyond the first five; contact us about availability. Signup or a claim attempt does not authorize a payment or automatic debit. The account approval, security and acceptable-use terms still apply.
5. Payments, bookings, and requests
Uploading payment proof does not mean a payment is approved or cleared. An authorized HOA officer reviews it, and the recorded status and issued receipt reflect that decision. Verify payment instructions with your HOA, and do not submit false or altered proofs.
Facilities can be booked only from available slots opened by your HOA. Availability, approval, cancellation, charges, and use are subject to the facility's applicable rules. A pending request is not a confirmed booking; rely on its current recorded status. Document requests, issue reports, and service requests are likewise subject to review, requirements, and availability.
myKomunidad is not an emergency response service. Do not rely solely on app alerts, messages, or reports for urgent medical or security emergencies; contact the appropriate emergency services or your community's emergency contacts directly.
6. Content, workers, and voting
You retain your rights in content you submit. You grant myKomunidad the limited permission needed to store, process, display, and deliver that content to its authorized audience for operating the service. Upload only material you are entitled to share and respect other people's privacy and intellectual property.
Service providers are responsible for their work and agreements with customers. A listing or verified status is not a guarantee of quality, safety, licensing, or results. Only eligible homeowner and renter members may review the worker assigned to their completed job. Reviews must be truthful, relevant, and free of harassment or unnecessary personal information.
Participate in ballots only if eligible, do not interfere with voting or attempt to identify anonymous voters, and keep your receipt codes private if you do not want others to associate them with you. Your HOA is responsible for election procedures and eligibility; an audit ledger does not by itself establish legal election compliance.
7. Acceptable use
Do not use the service for fraud, harassment, threats, unlawful discrimination, malware, spam, or unlawful disclosure of personal information. Do not manipulate payments or votes, forge IDs or receipts, scrape private records, bypass permissions, disrupt the service, or exploit security weaknesses. Report suspected vulnerabilities privately to the contact below.
We may restrict access or remove content when reasonably necessary to protect users, investigate misuse, enforce these terms, or comply with law. Where appropriate and lawful, affected users may ask for an explanation or review. Urgent security measures may require immediate action.
8. Availability and AI assistance
We aim to keep the service useful and available, but interruptions, maintenance, network problems, and third-party outages can occur. Cached or offline information may be outdated. Confirm critical records once connected. Notifications, sounds, and installation depend on your device, browser, permissions, and supported services; delivery is not guaranteed.
AI compliance reviews and document summaries are assistance only. They may omit requirements or contain errors and are not legal advice, official DHSUD approval, or a substitute for professional review. Officers remain responsible for checking source documents, deadlines, and filings with the relevant authority.
9. Ending access and liability
You may stop using the service and request account closure through the contact below. Your HOA may change access when membership or duties change. Closure or suspension does not cancel outstanding lawful obligations or automatically erase records that must be retained; see the Privacy Policy.
To the extent permitted by applicable law, myKomunidad is not responsible for losses caused by inaccurate user or HOA records, independent provider conduct, device or network failures, or unauthorized credential sharing outside its reasonable control. Nothing in these terms excludes liability that cannot legally be excluded, limits mandatory consumer or privacy rights, or excuses fraud, willful misconduct, or obligations imposed by law.
10. Philippine law, concerns, and updates
These terms are governed by applicable Philippine law. Please contact us first about platform concerns so we can try to resolve them. This does not prevent you from seeking remedies from the appropriate Philippine courts, regulators, or other competent authorities. Community disputes should also follow applicable HOA procedures where appropriate.
We may revise these terms as the service changes. Updated terms and their date will appear here, and material changes will be communicated through appropriate channels. Changes do not remove accrued rights or replace any additional agreement required by law.
